An attorney shall be retained on an annual basis for the purpose of providing legal services to the administration of the enforcement of the Code of Ethics and Arbitration. Normal contact with the Association shall be with the Administrative Services Director and the Chief Executive Officer. However, as matters and issues arise which demand the attention of elected officers, it is your obligation as a hired professional to communicate such matters and issues with the elected officers.
RESPONSIBILITIES
- Be available for inquiry on enforcement procedures of the Code of Ethics and Arbitration by the CEO, Administrative Services Director, and the current President. Any other contacts require approval by the CEO or the President of the Association.
- Provide legal defense for Professional Standards panels as necessary, at a cost to be determined the Board of Directors.
- Attend committee meetings of the Statewide Professional Standards Review Committee. The Committee meetings are held during the Convention and Fall Meetings. Additional meetings of the committee may be called when necessary.
- Be available to attend annual Professional Standards training conducted by the National Association of REALTORS®.
- Be available to attend Professional Standards hearings when necessary.
- Review Professional Standards complaints as requested by the Grievance Committee.
- Review Professional Standards panel decisions and draft appropriate language.
- Attend an annual review conducted by association leadership.
- Be knowledgeable in the following areas: Association membership requirements, Association Professional Standards policies and procedures, MLS policies, Anti-Trust laws, Real Estate License Laws.
